Terms of service

1. Our agreement

These Terms govern your use of superbly’s website, chat, agent, and API services (the “Service”). The Service is provided by Twolabs Inc., doing business as Superbly AI, a Delaware company (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. Our Privacy Policy explains how we handle personal information.

You must be legally able to enter this agreement. If you are below the age of legal majority where you live, a parent or guardian must agree on your behalf and supervise your use. The Service is not intended for children under 13. If you use it for an organization, you must have authority to accept these Terms for that organization.

2. Your account

Provide accurate account information, keep your credentials and API keys secure, and let us know promptly if you suspect unauthorized access. You are responsible for activity you authorize through your account. Do not share an account in ways that compromise its security or allow someone to evade usage limits.

3. AI answers and agent actions

AI can make mistakes, invent information, and produce incomplete or outdated results. Review outputs before relying on them or sharing them. The Service does not replace qualified professional advice or emergency services. You remain responsible for decisions you make using its output.

Agent mode can use tools, access connected services, and perform tasks you request. Give clear instructions, connect only accounts you have permission to use, and review approval requests carefully. An approval authorizes the action described. A scheduled task may run later without you present. Some authorized actions can run without another confirmation; do not assume every step will pause for approval. Stop or change a task if you no longer want it to continue.

Third-party websites, connected apps, and model providers have their own terms and may change or become unavailable. You are responsible for permissions, purchases, communications, and other commitments you authorize through those services.

4. Your content

You retain the rights you have in the content you provide. You give us permission to process, transmit, and store that content as needed to provide the features you use, maintain the Service, and comply with law, as described in our Privacy Policy. Only provide content you have the right to use and share with the relevant services.

As between you and us, you may use the output we provide to the extent permitted by applicable law and third-party rights. AI output may not be unique or eligible for intellectual property protection. These Terms do not give you ownership of our software, branding, or another person’s content.

5. Use the Service responsibly

Do not use the Service to:

• Break the law, infringe others’ rights, commit fraud, or impersonate someone deceptively.
• Abuse, exploit, or endanger people, including children.
• Access accounts or systems without permission, distribute malware, or send unlawful spam.
• Bypass security, approval controls, rate limits, billing, or other access restrictions.
• Disrupt the Service or obtain another user’s private information.

6. Plans, credits, and payments

Current plans and usage prices appear on our Pricing page and at checkout. Charges depend on the features, models, tools, and computing resources used; an unsuccessful task may still consume resources. We show recorded usage in your account. Review the price, billing interval, taxes, and credit terms shown before purchasing.

Subscriptions renew at the interval and price disclosed at checkout until canceled. You can manage or cancel a subscription through Settings. Cancellation stops future renewal; the billing portal shows when it takes effect. Contact us if you cannot access cancellation. We will disclose material price changes before they apply to your renewal.

Plan credits are subject to the billing period shown in your plan. Purchased top-up credits do not expire monthly. Credits are for Service usage and are not a bank deposit or transferable currency. Promotional credits may have separate conditions disclosed with the offer. Account deletion removes access to unused credits.

For billing errors, refunds, or unused-credit questions, contact team@twolabs.ai. Refunds and cancellations are subject to applicable consumer law and any terms shown at checkout. Nothing here removes a statutory refund, withdrawal, or other consumer right.

7. Availability and ending use

Features, models, and integrations may change. We do not guarantee uninterrupted availability, error-free output, or completion of every task. Where permitted by law, the Service is provided on an “as available” basis. This does not limit warranties or remedies that cannot legally be excluded.

You may stop using the Service and delete your account in Settings. We may restrict or suspend access when reasonably necessary to address a breach of these Terms, security risks, nonpayment, or legal requirements. Where practical and lawful, we will explain the reason and provide an opportunity to resolve it. Contact us to ask for a review.

8. Governing law and your rights

Delaware law governs these Terms, except where the mandatory law of your place of residence requires otherwise. You keep any mandatory consumer protections and rights to bring a claim in a court available to you by law. Nothing in these Terms excludes liability that cannot lawfully be excluded.

Please contact us first about a concern so we can try to resolve it. These Terms do not require arbitration or waive your right to participate in a class action.

9. Changes and contact

We may update these Terms as the Service evolves. We will publish the revised Terms and effective date here and provide notice of material changes where required. Changes will apply prospectively. If you do not agree to an update, you can stop using the Service and cancel your subscription.
